http://www.youtube.com/watch?v=7HW7JjnoqGo

NL= news lady
K= Kirstin

"Plus the pudget sound business journal hits the stands with an explosive report on the fall of washington mutual, maybe it didnt have to happen. We'll find out why just ahead."

.......
"but first a new investagive report by the Pudget sound business journal that questions the fall of washington mutual. Could wamu have survived? And joining me is Kirstin Grind the reporter who broke the washington mutual story.

News Lady: Welcome o the program.
Kirstin: Thanks you
NL: You've been pouring over hundreds of internal financial documents associated with wamu's fall. What have you uncovered which was previously not known.
K: basically what we found is that on the day wamu was taken over by government officials it actually had more than enough cash to operator and also met all of its requirements for being a financial healhty bank at tha time.
NL: so the fall may not have needed to happen? I remember at the very end .. people were running to their atms taking money out of atms.... billions of dollars. but your saying the bank still had plenty of cash reserves on hand?
Kirstin: Exactly thats whats interesting about this, the bank actually did have more than 16 billion dollar bank run before govermt stepped in and previously another one that summer. But the bank chains had been prepared for that, they were prepared for a situation that would drop cash on hand down to 25 billion. And on the day of seizure they still had 29 billion.so they were above that level.
NL:So they probably could have held out long enough to receive tarp? Troubled asset relief program, which was only what a couple of days away?
Kirstin: Exactly and also the executives were working on their own trying to find a buyer for the bank or additional capital. So it looks like they could have organized a sale or getting more money on their own rather than having the government come in and wipe out all the shareholders.
NL: Which makes it seem like the Fed regulators jumped the gun. You know they sort of pulled the trigger a little too soon and they were infact undermining the efforts of Allen Fishman who had taken over from Kerry Killinger, the CEO’s job and trying to find a buyer, and maybe the FED, they didn’t allow that to happen.
Kirstin: It does, and the other interesting thing about the story is their unwillingness to really talk to us about the process and really the it’s the secrecy that surrounds all bank closures.. right now we have had over 140 bank closures since the housing bubble burst and with a lot of them you just don’t know why regulator stepped in. Definitely their needed to be failures, but they just don’t really explain their actions.
NL: well maybe we wont know why officially, but we can probably guess. Doesn’t it seem logical that maybe the FDIC didn’t want to drain its coffers by paying out the billions nad billions of dollars it would have had to if Wamu had gone belly up? Maybe it wanted JP Morgan and Chase to take over so it wouldn’t have to spend the money?
Kirstin: Exactly and that is what we point out in this story. They had just dealt with IndyMac the Mortagage lender in California that had tapped the insurance fund to the tune of 10 million dollars. Here they saw wamu who had made all these bad loans, made all these bad loans, suffered through two bad bank runs, what is going to happen? It is totally plausible as to why they decided t move in.
NL: And in one sense, one could argue that the takeover by JPMorgan was “successful” (she does quote bars) because not one dollar of FDIC money was spent , tax payer money.
Kirstin: exactly, to the FDIC it was a very successful take over. And they continued to point to it as a very successful takeover the problem is the toll to all these shareholders, and employees, which were massive.
NL: Thousands and thousand of shareholder and bondholders who had their life savings and their college funds and retirements tied up in it, billions of dollars were lost. There is an even more.. your story talks about an even more extreme human toll
Kirstin: exactly, we talk a lot about the human toll in this story. And a lot of the human toll is wamu’s employees, many of them worked for decades, loved the job and the company. Unfortunately a few months ago one of the higher level executives took his own life because of financial pressures related to the wamu collapse. And that’s an extreme example, but there rae shareholders all over the country who have lost their retirement funds, their life savings, all for a bank that could have possibly been sold on its own.
NL: and one may wonder too why that this 29 billion dollars that you said they had wasn’t used to pay those investors. Is that still be ing worked out (I laughed when I heard that)
Kirstin: right, well there are a lot of lawsuits surrounding this closure and a lot of money that was left on hand that has a lot of legal rangling going on over that right now.
NL: Well I am sure you will be following up on that.. thanks for taking the time.
Kirstin: Thank you

http://www.ghostofwamu.com/documents/09-50551/09-50551-0168.pdf

Nota del escrito sobre el acuerdo:
The Debtors, JPMorgan Chase Bank, N.A., Federal Deposit Insurance
Corporation as Receiver, the Official Committee of Unsecured Creditors, WMB Bondholders, and the Office of Thrift Supervision (collectively, the "Parties") in the above-captioned proceedings (the "Actions") have determined that certain documents and information produced
or to be produced during discovery in the Actions, as defined in the Confidentiality Stipulation and Protective Order attached hereto as Exhibit 1, should be kept confidential in order to protect the legitimate business and privacy interests of the Parties, their customers and other persons,
including non-parties to the Actions.
