Obviously expectations are running high today, so seasoned longs will have stocked up on patience pills.

By now everyone knows Brian Rosen reiterated WMI's position that the commons are worthless. By limiting his focus to the commons, he retrenched from the blanket claim that 'all' equity is worthless, and I expect this did not escape the most acute listeners. (Even Weil cannot argue the preferreds are worthless in the face of A so closely approaching L, so it must tacitly acknowledge that preferreds will have some value given expected payments from NOLs, etc.)

As for the commons, Weil will continue to argue their worthlessness for the reasons I discussed at length some weeks ago. Moreover, and I would not expect laypeople to have thought of this, I have no doubt WMI's securities counsel has investigated case law about the potential '34 Act liability for referring to future value of securities based on projected litigation recoveries. Indeed, this would be another reason arising under the '34 Act why Weil would not contradict the MORs. Again, calling equity worthless is the safest position for WMI and its professionals, and the one the SEC likes best.

Increible lo de las P, siguen enchufadisimas. Que pena que cambiara la mitad por comunes, pero weno aunque sea la miatd todavia da alegria verlas saltar tan alto. A ver cuando les toca a las comunes, esperemos que esta noche se cubra bien la noticia y magnana ya no que suban sino que al menos no bajen!!

No es así Rosen lo sostiene para salvaguardar el culo de Weil de posible Class Action Lawsuits derivados de sus predicciones. Es mejor ser pesimistas y conseguir recovery a decir que van a conseguir xxxxx y después fallar.
