I always like to say when you judge someone/something, never go on what people say because they will generally lie, if it means self improvement-one way or the other. Always judge if possible on ones actions, as this will be you true and factual lead to an end. I do believe the WaMu saga is entering its final stages as the whole case is getting ready to blow wide open when you consider a Judge whose opinion is so embarrassing she should have been ashamed to put her name on it along with insider trading, and so much more I will not even go into because most longs already know or should know.

The actions by Rosie confirm what many of us knew or thought for quite a while and that being (Bopfan EXACTLY correct) WMI could NOT receive an extension to the agreement of FDIC/JPM or it would have been broadcast to the ENTIRE world by now. All Rosie is doing is buying time and trying to keep the prices of equities from exploding until he can get some kind of resolve, but it will NOT be what he has been trying to achieve.

The two choices that Tepper has now are either allow Equity to join in on the so called revised POS POR Cwrap and give up part of WMI he was trying to steal or be satisfied with only getting par and being crammed down which means Tepper, Weasel/Gotcha/Mangle and other COULD be without releases when the FDIC and or JPM makes a deal with Equity. He would also face certain prison time for insider trading that I am sure CAN and will be proven. This would explain why Rosie says he intends to file something as opposed to a definite solution to this mess. I say the ending could be very soon because if Tepper agrees and Equity is included and Susman agrees, this could be over within hours, days or a few weeks. The other side of this coin is Equity will still ULTIMATELY, win but could be a much longer wait.

Washington Mutual Inc., former parent of the biggest U.S. bank to fail, missed the deadline for approval of its bankruptcy plan, making a related, $10 billion settlement subject to cancellation, a company lawyer said.

The missed deadline means the parties involved in the settlement, JPMorgan Chase and the Federal Deposit Insurance Corp., have the option to cancel the agreement, said Brian Rosen, a WaMu attorney.

The settlement, which splits billions of dollars worth of tax refunds and cash, is the central feature of WaMu's bankruptcy-exit plan, and JPMorgan and the FDIC are unlikely to pull out of the deal, Rosen said.

WaMu, based in Seattle, also missed a self-imposed Jan. 31 deadline to file a new version of its exit plan after U.S. Bankruptcy Judge Mary F. Walrath in Wilmington, Del., rejected the first version.

"We are trying to work out some nuances in the plan," Rosen said Tuesday.

Tenemos pendiente de resolver:

1) Hoffman motion to reconsider denial of motion to unseal

2) EC motion for 2004 investigation of hedge fund insider trading

3) EC motion for certification of direct appeal of GSA "fair and reasonable" opinion

Tambien sabemos de manos de JPM:

"Furthermore, as a matter of bankruptcy pragmatism, any appeal should consider the Global Settlement Agreement and the Plan together. The Global Settlement Agreement is premised on a Plan in a form acceptable to JPMC and the other settling parties. This includes a Plan containing approved third party releases. As of now, there is no confirmation order, no final Plan, no approved Plan releases and no final settlement for an appellate court to review. The Equity Committee will undoubtedly continue to fight on all these fronts. The Equity Committee's appeal therefore is premature and seeks to divide appellate issues that should be considered together at the appropriate time. The Petition should be denied."

And of course we may suppose that FDIC/JPM/BoD won´t extend the GSA just because of Hedgefunds, so I really think EC has some leverage and ,with approved motions, we´ll get more.

If not approved, well that does not give FDIC or JPMC the necessary 3rd Party relaeses.... we are far from dead and this isn´t over for a long shot :)

Personalmente crees que la investigación federal donde (segun comentaste), dice que la incautacion o secuestro de WMI por pare de FDIC fue un error pueda servir como instrumento oficial para nuestra causa?
