After reviewing the EC, TPS, and Blackhorse objections to the DS, I'm seeing a strategy emerging that I like and gives me hope. I'm hoping this will be the final confrontation with the Debtors and it's going to be all or nothing.

1. Both TPS and EC want the DS/POR modified to include the outcomes that go against the Debtors. Current modified plan is Debtors get all they want or plan is not confirmed and they get to try again. If EC is successful with this, then confirmation can be used to finally rid ourselves of the Debtors.

2. A key modification is to account for the Federal Judgement Rate (FJR). The Debtors want the contract rate and the Noteholders to be the new post-confirmation owners of WMRRC with the right offering taken away from the H's and moved up the ladder to junior debt held by the same four hedge funds. If the FJR applies, then the junior debt can be paid in full and equity can become the post confirmation owners.

3. Lot's of argument on VALUATIONS and the NOLs. The Debtors modified plan want to kill a lot of the NOLs and become the new owners. If equity can become the new owners, there is a lot of money in the NOLs that can be used to pay equity.

4. Addressing the voting scams and Class 19. I like that we're fighting now to get these scam voting procedures removed. I'm not sure about the Class 19 issue with JPMC, but it appears related to JPMC releases. Can anyone help on how this would affect JPMC?

5. Trying to modify the DS/POR to allow EC to continue post confirmation and appeal or file and litigate additional items as long as they are "timely"

I think this all comes down to either the Debtor will win and get what they want or EC/equity will be able to expose enough extra value to cram down the hedge funds and take over WMI post confirmation with the NOLs, get money for the releases, and the Debtors are out and the EC can take over the liquidating trust and WMRRC. The discovery the EC is collecting and their value analysis will hopefully get them there. I'm looking to watch what Judge Walrath allows to be changed to the Debtors DS/POR. Those changes will be key on who wins and who loses in the next weeks.

Hay que tener poca verguenza para alardear de ganar cuando muchos que te siguieron en comprar a cualquier precio han sufrido enormes pérdidas. Lamentable, por eso el hilo se ha convertido en un desierto donde nadie cree lo que dices.
